ATS Real s.r.o., Company ID (IČO): 278 07 819, with its registered office at Tovačovského 92/2, 130 00 Praha 3, registered with the Municipal Court in Prague under File No. C 349217 (hereinafter the "Controller"), operates the website and, in accordance with the rules set out below, uses cookies and similar technologies in doing so.
1. Introductory Provisions
This policy describes how the Controller processes cookies and similar technologies in operating its website. The policy is issued in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (the "GDPR"), Act No. 110/2019 Coll., on the Processing of Personal Data, and Section 89 of Act No. 127/2005 Coll., on Electronic Communications, as amended.
2. What Are Cookies
Cookies are small text files that a website sends to the user's browser and that may be read again on the user's subsequent visit to the site. They allow the site to record information about the visit, such as the selected language, login status, shopping cart contents or other user settings. Cookies enhance the user-friendliness of a repeatedly visited website and are used by virtually every modern website.
3. Types of Cookies
Session (temporary) cookies allow individual user activities to be linked during the period of browsing the website. They are activated when the browser window is opened and are deactivated and deleted once it is closed.
Persistent cookies help identify the user's device on repeat visits to the website and allow the content of the site to be adapted to the user's needs. Persistent cookies remain on the device for a set period or until manually deleted.
From the perspective of purpose, we distinguish technical (necessary), preference, analytics and marketing cookies. Necessary cookies are required for the proper functioning of the site and are processed on the basis of the Controller's legitimate interest; other cookies are processed only on the basis of the user's demonstrable consent.
4. Legal Basis and Consent
In accordance with Section 89(3) of Act No. 127/2005 Coll., on Electronic Communications, as effective from 1 January 2022, cookies other than necessary ones are stored and read only on the basis of the user's demonstrable consent granted via the cookie banner (the "opt-in" principle).
Consent is granted for a maximum period of 12 months; upon expiry of this period, the user is asked to grant consent again. Consent may be withdrawn at any time by changing the settings in the cookie banner or by adjusting the settings of the internet browser. Withdrawal of consent does not affect the lawfulness of processing carried out prior to its withdrawal.
Internet browsers usually include cookie management tools. Within the browser settings, individual cookies can be manually deleted, blocked or their use entirely disabled. Further information is available in the help section of the specific internet browser.
5. Purpose of Using Cookies
We use cookies primarily to ensure the basic functionality of the website, to personalise content and advertising, to provide social media features and to analyse traffic. Information on how our website is used may be shared with our contractual partners in the field of analytics, social media and advertising.
Third-party services used may in particular include:
- Google (Google LLC, or Google Ireland Ltd.) — analytics and advertising tools;
- Meta / Facebook (Meta Platforms Ireland Ltd.) — social plugins and advertising;
- X / Twitter (X Corp.) — social plugins.
These providers may be established outside the European Economic Area; in such cases, the transfer is safeguarded by Standard Contractual Clauses approved by the European Commission (Judgment of the Court of Justice of the EU of 16 July 2020, Case C-311/18 — Schrems II) or another appropriate legal instrument pursuant to Article 46 of the GDPR.
6. Retention Period
The retention period of individual cookies varies depending on their type and purpose — session cookies expire when the browser is closed, while persistent cookies are stored for the period specified for the particular file, but no longer than 24 months. Consent to the storage of cookies expires after 12 months from the date it was granted.
7. Rights of the Data Subject
In connection with the processing of personal data through cookies, the user has, in particular, the right to access personal data, the right to rectification or erasure, the right to restrict processing, the right to object, the right to data portability and the right to withdraw consent granted. A complaint may be lodged with the supervisory authority — the Office for Personal Data Protection (www.uoou.cz).
All rights may be exercised with the Controller at the e-mail address info@atscompany.cz.
8. Final Provisions
The Controller is entitled to unilaterally amend this policy; the current version is always published on the website. This policy forms an integral part of the Privacy Policy of the Controller.
